PROJECTS:
- Evgeny's experience includes comprehensive representation of insurance companies in commercial risks insurance, namely, presentation of recourse claims to the debtor in the amount of RUB 0.3 billion, restatement of the liquidated debtor's details in the Unified State Register of Legal Entities, initiation and administration of debtor's bankruptcy proceedings, successful challenging of the transactions for the withdrawal of real estate and trademarks.
- Evgeny represented insurer's interests in an insurance dispute with a policy holder to recover the insurance indemnity in the amount exceeding RUB 0.5 billion in connection with the determination of the moment of occurrence of the state of the counterparty's insolvency.
- The debtor under the contract undertook to pay the debt to the creditor after recovering it from the 3rd party. The Client failed to collect the debt in the court of the first instance and appeal with another team of lawyers, as he did not prove that the debtor had received the money from the third party. Our team managed to convince the cassation court to order retrial, because the term had not been agreed in the contract, which means that the repayment was to take place within a reasonable time. At the new trial, the requirements of the Client were satisfied in full.
- Acting in the interests of the two largest insurance companies simultaneously, team of lawyers has developed a strategy for the collection of about 1 billion rubles from a Belgian company by subrogation. Correct qualification of the subject matter and grounds of the claim allowed to avoid an increase in expenses in connection with the transfer of the dispute to international commercial arbitration, as well as to increase the amount of recovery by more than 10 times. At the moment, the correctness of the analysis has been confirmed in the courts of all instances.
