PROJECTS:
  • Acting in the interests of the two largest insurance companies simultaneously, team of lawyers has developed a strategy for the collection of about 1 billion rubles from a Belgian company by subrogation. Correct qualification of the subject matter and grounds of the claim allowed to avoid an increase in expenses in connection with the transfer of the dispute to international commercial arbitration, as well as to increase the amount of recovery by more than 10 times. At the moment, the correctness of the analysis has been confirmed in the courts of all instances.
  • For other major player in the international insurance market we also settled a (subrogated) dispute for rub 0.6 bln. Situation: losses of the insurance company were caused by subrogation of claims against a distributor of products that was owned by a large Russian chain. The distributer was further re-organised into three legal entities, which were eventually recognised as insolvent and could not satisfy the claims of the insurer. During the proceedings the representatives noted that the chain was jointly and severally liable for the debts of the distributor, i.e. a subsidiary company.
    Result: the case was won.
  • Protecting Energy grid company from recovering actual losses to Mosenergosbyt PJSC. The formation of a position was complicated since the lawyers had to develop a meaningful position that would destroy a set of formal documents automatically generated within the plaintiff himself. The result was the denial of claims and the formation of proper approach in case law.
