Situation: losses of the insurance company were caused by subrogation of claims against a distributor of products that was owned by a large Russian chain. The distributer was further re-organised into three legal entities, which were eventually recognised as insolvent and could not satisfy the claims of the insurer. During the proceedings the representatives noted that the chain was jointly and severally liable for the debts of the distributor, i.e. a subsidiary company.
