RECOVERING DAMAGES: TRENDS IN JUDICIAL PRACTICE

In recent years, Russian court practice on recovering damages has become more favorable for claimants. Nevertheless, lawyers continue to complain about the lack of clear criteria for determining the amount of damages and about the overestimated standard of proving causation. There is also significant specificity in recovering damages from legal entities.

“Courts set a high standard of proof for amount of damages. That’s why, there still remains a discrepancy between the size of the satisfied claims and those initially declared in the lawsuit” – says Ilnar Abdulov, a lawyer of the Moscow LF “Kovalev, Tugushi and Partners”.
